Our Policy
This policy outlines Evomart’s position regarding the resale of refrigerant gas, pre-charged air conditioning and refrigeration systems, and any other systems containing refrigerant gases.
Evomart reserves the right to refuse the sale of any items containing refrigerant gas where certification and written assurances of compliance have not been verified. Evomart will ensure that adequate checks are completed prior to releasing any goods containing refrigerant gases.
The following guidance has been adapted from UK government guidance and outlines the steps end users and purchasers must comply with to ensure adherence to current regulations.
Requirements for Engineers and Technicians
Before purchasing products containing refrigerant gas, engineers and technicians should:
- Hold relevant certificates and qualifications.
- Employ people who hold the relevant certificates and qualifications.
If you sell F-Gas to a customer who will install, service, maintain, or repair equipment containing F-Gas, you must verify that the customer holds individual qualifications or employs appropriately qualified personnel.
If they are carrying out work on behalf of another company, you must also check that the customer holds the relevant company certification.
Record Keeping
As outlined within UK government guidance, businesses must keep records of:
- The customer’s certificate number.
- The quantities of F-Gases purchased.
These records must be retained for at least 5 years and produced to regulators upon request.
A person without qualifications may still collect, transport, or deliver F-Gases.
Letter of Assurance Requirements
Evomart requires a Letter of Assurance from every customer purchasing F-Gas products.
A Letter of Assurance is required where you are:
- A wholesaler selling to a reseller.
- A wholesaler or reseller selling to a certified or qualified engineer.
- A wholesaler or reseller supplying gas for collection, transport, or delivery on behalf of a certified or qualified engineer.
In the Letter of Assurance, customers must confirm that:
- They are permitted to buy or collect F-Gas.
- They will not intentionally release F-Gas into the atmosphere unless technically necessary.
- They will take all appropriate steps to prevent F-Gas leaks.
Letters from End Users
If you sell stationary refrigeration, air conditioning, heat pump, or fire protection systems, you must obtain confirmation from the end user regarding the qualified technicians responsible for:
- Installation.
- Servicing.
- Repair work.
- Decommissioning.
This requirement does not apply where equipment is hermetically sealed.
Hermetically sealed equipment includes systems where:
- The section containing F-Gas is permanently sealed, for example by welding or brazing.
- The equipment has a tested leak rate of less than 3g per year.
Legal Compliance
It is against the law to purchase or sell F-Gas products to individuals or companies that do not hold the required qualifications or certifications. Failure to comply may result in civil penalties under Environment Agency enforcement policies.
